Terms of Service

Terms and Conditions for Tuesday's Child Jewellery:

These terms and conditions govern your use of our website and services in general. By opting to browse our website or engaging with our services, you are agreeing to comply with these guidelines.

 

Jane Merrifield is the sole proprietor of Tuesday’s Child Jewellery Design, also referred to herein as ‘the artist’, 'Tuesday’s Child', 'us' or 'we'.

Making a Purchase/Agreement

Once you have enquired on an item, or contacted us about a service or item, we will acknowledge receipt of your order and provide an invoice or quotation. An order shall only be considered accepted once either a full payment, or payment of a pre-agreed deposit amount has been received against an issued invoice. Jewellery will not be delivered or made available for collection until full payment has been received against the relevant invoice.

 

Our main method of payment is via EFT. We reserve the right to only acknowledge receipt of payments once funds have reflected in our account.

 

Requests for changes to already accepted orders may be subject to additional charges due to wastage, and the need for additional time, materials and/or work done. Deposits will not be refundable after an order has been accepted, unless no materials are ordered and no work has been done before the cancellation request is received.

 

Any existing Intellectual Property owned by us incorporated into any work and Intellectual Property created by us as a result of an order shall vest with us.

 

Acknowledgement of services rendered and changes in orders after commencement.

Should the client change their mind regarding design or cancel the order after agreement has been reached, any deposits paid may be refunded less the full value of any materials already purchased, compensation for time spent and services already rendered and any other reasonable cancellation charges that may be applicable. ​

Cancellation by Us

We reserve the right to cancel transactions if the design or commission is found to be unviable or unrealistic. Customers will be notified promptly if such decisions are taken, and any monies paid by the client will be refunded less any materials purchased or time spent on manufacture within a reasonable amount.

 

Margin for artistic discrepencies

Unless agreed otherwise, or purchasing specific premade items, orders are for the creation of handmade artistic pieces of jewellery. As each product is made by hand there may be differentiation between repeat pieces and the final product may differ from any suggested technical specifications, including but not limited to shape, size, colour or finish. Where sizing of organic pieces are concerned the artist reserves the right to make a final decision as to the best course of action to reflect the best design.

Delivery and Packaging

Jewelry items are delivered securely and beautifully packaged. Our packaging varies at our discretion and depending on the needs of the item and its delivery method. Delivery charges vary based on location. We use reputable 3rd party couriers for deliveries and courier services. Delivery and courier costs will be for the clients account.

Online Purchases:

  1. Liability: We aim to provide accurate information but are not liable for errors or discrepancies on our site or conveyed during consultations. Customers must notify us promptly of any product issues for resolution.

  2. Accuracy, Completeness, and Timeliness of Information: We strive to provide accurate information on our site, but we do not guarantee its completeness or timeliness. You should use this information as a general guide and consult with us or other reliable sources when making decisions.

  3. Modifications to the Service and Prices: Product prices are subject to change without notice. We reserve the right to modify or discontinue our services at any time without prior notice. It is your responsibility to stay informed of any changes on our site.

  4. Products or Services: Certain products or services may be available exclusively online with limited quantities. We make every effort to display product colors and images accurately, but we cannot guarantee precise color representation. We reserve the right to restrict sales to specific regions or individuals and alter product descriptions or prices at our discretion.

Tuesday's Child Returns Policy

As the artist is hand making each item, we generally cannot provide refunds, as input and costs start accumulating early in the process. We do however strive to deliver to a high standard that keeps our clients coming back. Please see our returns policy below for more.

 

Customers are advised to please inspect their purchases on receipt, before removing any tags or disposing of any packaging, and to please inform us of any breakages or defects via email at info@tuesdayschildjewellery.com, within 48 hours of receipt of the items, subject to terms and conditions regarding the return for defective goods. 

Once your order has left our workshop we have no control over how it is handled or in what condition it arrives at your door.

RETURN OF DEFECTIVE GOODS 

If the goods, delivered to the customer, are not in good order, or are defective on delivery, or break / become defective as a result of a manufacturing fault, within 3 months of delivery, having regard to the use to which the goods would be normally put, the customer may return these goods. 

If, at the artists discretion, an item is found to be of unsatisfactory quality and for reasons mentioned above, the artist will opt to either repair or remake the item.

We reserve the right to inspect and assess the faulty/damaged items at our workshop, where an outcome will be decided on, taking fair wear and tear into account.

After assessment, The artist reserves the right to change the design of the remake if the artist, at the artists sole discretion, determines the original design to be un-viable. 

If the goods in question are repaired or remade during the 1 month period mentioned above, such repairs will carry a further warranty of 1 month from the date of repair. 

In relation to the quality or durability of goods, please note that they will not be considered defective, and therefore not be returnable, if: 

  • the consumer has been expressly informed that particular goods were offered in a specific condition; or

  • the nature of the specific design makes it such that a reasonable person would likely appreciate that the item requires delicate treatment, and the defect has likely arisen from a failure to treat the goods with the appropriate delicate treatment after delivery; or 

  • the consumer has expressly agreed to accept the goods in that condition, or knowingly acted in a manner consistent with accepting the goods in that condition

  • upon assessment by the artist, we find the goods to be in acceptable order with the dissatisfaction of the client arising from unrealistic expectations.  

  • Notwithstanding the above, no returns will be accepted for: 

  • goods that have been altered after leaving our control 

  • goods that have been partially or entirely disassembled; or 

  • that have been permanently installed, affixed, attached, joined, or added to, blended, or combined with, or embedded within, other goods 

  •  

Please note that in all instances relating to the return of goods, we are entitled to charge the customer a reasonable charge for 

  • any delivery fees 

  • additional time and material needed to render an unviable design viable. 


Ring Resizing

In the instance that a ring is ordered in the incorrect size, re-sizing the ring may, at the artists sole discretion, incur a charge. Due to the type of setting and stone used, in some instances, we cannot guarantee that the ring can be re-sized.

Please be aware that re-sizing a ring is a significant exercise and the associated costs may be in excess of the original purchase price of the ring. All jewellery must be returned in person or by one of the artists recognised couriers, at the expense of the customer.

South African Laws Apply. These Terms and Conditions and any separate agreements with us, shall be governed by and construed in accordance with the laws of South Africa.

Intellectual Property Rights

Copyright and Intellectual Property Rights for purposes of these Terms, Intellectual Property Rights means all intellectual

property rights including, artistic and other designs, copyright, trademarks, trade secrets and know-how, applications and registrations, renewals, and extensions.

 

Unless the contrary is specified in these Terms, all content contained on the Website, or incorporated or embedded in any service offered on the Website, including software, images, text, graphics, illustrations, logos, branding, photographs, and all Intellectual Property Rights in such content, belongs exclusively to the artist. You agree that you will at no time lay claim to the

artists content, and to any Intellectual Property Rights subsisting in such content. Any existing Intellectual Property owned by us incorporated into any work and Intellectual Property created by us as a result of an order shall vest with us.

 

 

Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license to any Intellectual Property Rights belonging to the artist, and you agree that you will not:

Modify, port, translate, localise, or create derivative works of the artist’s content.

Decompile, disassemble, reverse engineer, or attempt to reconstruct, identify, or discover any source code, underlying ideas, underlying user interface techniques or algorithms contained or incorporated in any of the artists’ content.

Disclose any of the artists’ content.

Sell, lease, license, sublicense, copy, market, reproduce, transmit or distribute the artists’ content.

Knowingly take any action that would cause any of the artists’ content to be placed in the public domain.

You understand and acknowledge that you may be exposed to user content that is inaccurate, misleading, and offensive.

You agree that the artist will not be liable for any damages you allege to incur because of exposure to such user content.
